PRACTICE FOCUS
Tuck Sun’s primary focus is in the area of commercial and corporate litigation and arbitration. He advises clients on shareholders’ disputes and company law related issues, including cross-border disputes. He also advises on aviation law, competition law, defamation law, insurance law, IT-related contracts, and telecommunications matters, and handles related litigation.
Tuck Sun is also empanelled as an arbitrator with the Singapore International Arbitration Centre and the Asian International Arbitration Centre.
EXPERIENCE AND CREDENTIALS
In the field of Dispute Resolution, Tuck Sun has been named as a Litigation Star by Benchmark Litigation Asia-Pacific in its 2018 to 2021 editions, as a Leading Individual in the 2016 to 2021 editions of Chambers Asia Pacific, and as a Recommended Lawyer in the 2013, 2015 and 2016 editions of Asia Pacific Legal 500. He has been named as a Distinguished Practitioner in its 2020 and 2021 editions of Asialaw Leading Lawyers. In the 2015 edition of Asialaw Profiles, he was named as a Recommended Individual, in its 2019 edition as a Leading Lawyer and in its 2020 edition as a Distinguished Practitioner.
His recent notable experience include:
- Acting for a prominent domestic ship management company in both arbitration and court proceedings in relation to a dispute on shares, on a novel point of law
- Successfully settling proceedings for an international telecommunications company in relation to a claim for breach of contract in respect of a strategic investment in a local telecommunications company where the claim sum was approximately USD 200 million
- Successfully defended a foreign reinsurer company in an arbitration in relation to a claim for an alleged breach of a reinsurance treaty
- Acting as sole arbitrator in various arbitrations involving claims for breaches of contract and breaches of fiduciary duties
Tuck Sun is certified as a ‘Tutor Trainer Trial Advocacy’ by the Honourable Society of Lincoln’s Inn (2011) and has been actively involved in the Advocacy training programme run by the Malaysian Bar.
He is a Contributing Editor of Malaysian Civil Procedure 2021, 2018 and 2013 editions published by Sweet & Maxwell Asia. He is also the Co-contributor and Updating Editor of the Companies (General) Volume in Malaysian Court Forms in Civil Proceedings, published by LexisNexis in 2010 and an author of the Computer Crimes Chapter in Halsbury’s Laws of Malaysia – E-Commerce (Volume 16(1)) in 2009; recently updated in January 2022.
Tuck Sun has also given presentations on topics related to civil litigation, commercial transactions and insolvency.
Tuck Sun graduated with a Bachelor of Laws (Hons) from University of London (External) in 1995 and was called to the Degree of Utter Barrister of The Honourable Society of Lincoln’s Inn in 1996. He was admitted as an advocate and solicitor of the High Court of Malaya in 1997.
